Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of Axis Analytics ("we", "us", or "our") and the services available at axisanalytics.co.uk (the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
Account Registration
To use the Service, you must:
- Sign in using your Google account via OAuth 2.0
- Have access to at least one Google Analytics 4 property
- Be at least 18 years old (or the age of majority in your jurisdiction)
- Provide accurate and complete information
- Maintain the security of your account credentials
You are responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account.
Free Trial
We offer a 14-day free trial to new users. During the trial period:
- You have full access to the Service features
- Payment information is required to start the trial, but you will not be charged during the trial period
- You may cancel at any time during the trial without charge
- You will be notified before the trial ends
- If you do not cancel before the trial ends, you will automatically be enrolled in a paid subscription and charged the monthly subscription fee
Each user is entitled to one free trial. We reserve the right to deny trial access to users who have previously used a trial.
Subscription and Billing
Subscription Plans
After your free trial, you must subscribe to a paid plan to continue using the Service. Subscription plans are billed monthly and include:
- Access to your connected GA4 properties
- Real-time 3D globe visualisation
- Analytics dashboard
- Support and updates
Payment
All payments are processed securely through Stripe. By subscribing, you authorise us to charge your payment method:
- Monthly subscription fees are charged in advance
- Payments are non-refundable except as required by law
- You are responsible for all applicable taxes
- Prices are subject to change with 30 days' notice
Cancellation
You may cancel your subscription at any time through your account settings. Upon cancellation:
- You retain access until the end of your current billing period
- No refunds will be issued for partial months
- Your data will be retained for 30 days in case you wish to resubscribe
Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Use the Service in any way that violates applicable laws or regulations
- Attempt to gain unauthorised access to the Service or other users' accounts
- Interfere with or disrupt the Service or servers
- Use automated systems (bots, scrapers) to access the Service
- Reverse engineer, decompile, or disassemble any part of the Service
- Remove or alter any copyright, trademark, or proprietary notices
- Use the Service to access Google Analytics data you don't have permission to view
- Share your account credentials with others
Google API Services
The Service uses Google API Services to access your Google Analytics data. By using the Service, you also agree to:
- Google's Terms of Service
- Google's Privacy Policy
- Google API Services User Data Policy
You can revoke our access to your Google account at any time through your Google account settings at myaccount.google.com/permissions.
Google Analytics API Limitations and Quotas
The Service is dependent on Google Analytics API to access and display your data. The following limitations apply, which are outside of our control:
API Quotas and Rate Limits
Google imposes quotas and rate limits on API requests to Google Analytics. These limits may vary based on your Google Analytics property tier and usage. If these quotas are exceeded, the Service may experience:
- Temporary delays in data display
- Reduced data refresh rates
- Temporary inability to access your analytics data
- Error messages when data cannot be retrieved
Shared Quotas
If you or others in your organisation use other services or tools that access the same Google Analytics property, API quota consumption is shared across all applications. This means:
- Other services accessing your GA4 property may consume part of your available quota
- High usage by other applications may limit the Service's ability to fetch your data
- We cannot control or monitor quota usage by third-party applications
Data Accuracy and Availability
The Service displays data provided by Google Analytics. We are not responsible for:
- Accuracy, completeness, or timeliness of data provided by Google Analytics
- Delays in Google Analytics data processing (typically 30-60 seconds for real-time data)
- Discrepancies between data shown in our Service and Google Analytics interface
- Changes to Google Analytics API functionality or data availability
- Temporary or permanent discontinuation of Google Analytics services
Service Adjustments
To help manage API quota usage and ensure optimal performance, we may adjust default refresh rates or implement caching mechanisms. You can configure refresh rates in your settings, but we recommend staying within reasonable limits to avoid quota exhaustion.
Intellectual Property
The Service and its original content, features, and functionality are owned by Axis Analytics and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.
Data and Privacy
Your use of the Service is also governed by our Privacy Policy. Key points:
- We access your Google Analytics data only when you use the Service
- We do NOT store your Google Analytics data on our servers
- We securely store OAuth tokens to maintain your connection
- You can delete your account and data at any time
Service Availability
We strive to provide reliable access to the Service, but we do not guarantee that:
- The Service will be available at all times or without interruption
- The Service will be error-free or completely secure
- Any defects will be corrected immediately
- The Service will meet your specific requirements
Limitation of Liability
To the maximum extent permitted by law, Axis Analytics shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use or inability to use the Service
- Any unauthorised access to or use of our servers
- Any interruption or cessation of the Service
- Any bugs, viruses, or other harmful code
- Any errors or omissions in content
Our total liability to you for all claims arising from the use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
Disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Indemnification
You agree to indemnify and hold harmless Axis Analytics and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including:
- Breach of these Terms
- Non-payment of subscription fees
- Illegal or fraudulent activity
- At our sole discretion
Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Axis Analytics regarding the Service and supersede all prior agreements and understandings.
